AI & Automation Terms – ZopDev

Entity: ZopDev Technologies Pvt. Ltd. (“ZopDev”)

These terms govern the use of ZopDev’s AI-powered and automation features (“AI Features”) that assist with recommendations, optimizations, or generated content within the Services. By enabling or using AI Features, the Customer agrees to these terms as part of the Master Terms and applicable Service-Specific Terms.

1.1 Inputs, Outputs & Ownership

  • Customer Responsibility: The Customer is solely responsible for the content of prompts, inputs, and data submitted to AI Features (“AI Inputs”), as well as for reviewing, validating, and deciding how to use generated outputs (“AI Outputs”).

  • Ownership:

    • Subject to the Agreement, the Customer owns AI Outputs generated from its AI Inputs, except where such Outputs contain ZopDev-generated content or third-party materials.

    • ZopDev retains all rights, title, and interest in and to the underlying AI models, algorithms, datasets, and related intellectual property that power the Services.

1.2 Non-Determinism & Human Oversight

  • AI Features may generate variable or non-deterministic Outputs even from identical Inputs.

  • Customers must exercise human judgment, validation, and testing before relying on AI Outputs for business, operational, or production use.

  • ZopDev disclaims liability for decisions made solely based on AI-generated content without appropriate human oversight.

1.3 Restricted Content & Sensitive Data

  • Customers must not use AI Features to generate, transmit, or promote content that is:

    • Unlawful, harmful, deceptive, infringing, or discriminatory; or

    • In violation of ZopDev’s Acceptable Use Policy (AUP).

  • Customers must not submit highly sensitive or regulated personal data (such as financial, health, biometric, or government-issued identifiers) unless:

    • The relevant product explicitly supports such processing; and

    • The Customer has a lawful and documented basis for doing so under applicable law.

1.4 Safety & Abuse Prevention

  • ZopDev actively monitors for misuse and may throttle, filter, or block Inputs or Outputs to maintain Service integrity and user safety.

  • In cases of repeated or severe violations, ZopDev may suspend or terminate access in accordance with the Acceptable Use Policy and the Master Terms.

1.5 Improvements & Telemetry

  • ZopDev may use de-identified and aggregated telemetry (e.g., performance metrics, error rates, prompt categories) to improve the safety, reliability, and effectiveness of AI models.

  • ZopDev does not use Customer Data or AI Inputs to train foundation or general-purpose models for unrelated products without the Customer’s explicit, informed consent.

  • Any diagnostic or improvement data collected is handled in accordance with the Data Processing Addendum (DPA) and applicable data protection laws.
